Terms of Service

1. Service Description

FOXTANA AI provides multi-AI, multi-cloud conversational AI services across voice, text, and messaging channels. Services include but are not limited to: AI-powered voice agents, text chat, multi-channel messaging (WhatsApp, SMS, Alexa, web), and enterprise integrations.

2. Billing & Payment

• Pay-as-you-go: You are billed based on usage (tokens consumed, audio seconds processed)
• Minimum quality: Plans start at $99/month — we don't sell below our quality standard
• Free trial: New accounts receive 100 minutes of free usage (no credit card required)
• No lock-in: Cancel anytime. Export your data anytime. No cancellation fees
• Currency: All internal accounting in MXN. Prices displayed in your local currency
• Peak Charm: At $0 balance, services gracefully downgrade — we never block your customers

3. SLA Commitments

• Casual tier: ~95% on-topic responses (system instructions only)
• Premium tier: Multi-layer quality guardrails
• Forbes tier: 99.7% corpus adherence SLA with 5-layer enforcement and audit trail
• If a guaranteed response escapes all quality layers, it is logged, flagged, and credited

4. Acceptable Use

You may not use FOXTANA AI to:

• Generate spam, phishing, or fraudulent content
• Impersonate real individuals without consent
• Process data in violation of GDPR, HIPAA, or applicable regulations
• Exceed your plan's session or cost limits via circumvention
• Reverse engineer, scrape, or resell FOXTANA AI services

5. Intellectual Property

• Content you create through FOXTANA AI belongs to you
• FOXTANA AI, JOSFOX, and associated branding are trademarks of JOSFOX SAS de CV
• The .jos Open Standard is available under its published license terms

6. Enterprise Terms

Enterprise customers (Forbes / Custom tiers) receive additional terms including:

• Physical tenant isolation with dedicated infrastructure
• SSO integration (Okta, Azure AD, Google Workspace)
• Custom SLA with financial penalties
• Data processing agreement (DPA)
• Custom implementations available on request

7. Limitation of Liability

FOXTANA AI is provided "as is." JOSFOX SAS de CV's total liability shall not exceed the amount paid by the customer in the 12 months preceding the claim. AI-generated responses may contain errors — human review is recommended for critical decisions.

8. Governing Law

These terms are governed by the laws of the state of incorporation of JOSFOX SAS de CV. Disputes shall be resolved through binding arbitration.
